1, Definition of parties for the basis of the contract in accordance with these terms and conditions

  • A, Throughout these terms and conditions prop hire by elite which is a trading name for elite auctions will be referred to as the company
  • B, Throughout these terms and conditions any individual acting alone or on behalf of a company will be referred to as the customer.
  • C, RV is the replacement value of the item hired if it is lost or damaged beyond repair this is payable by the customer
  • D, Standard Props is an item hired or purchased by the customer from the company Prop definition: props are hired as seen and dispatched after the customer has inspected and ensured they are fit for purpose on a no return policy
  • E, Electrical Props, these props are hired untested and are the sole responsibility of the Customer to ensure they are safe and fit for purpose for their intended use.

2, The Contract

  • A, The  contract is  in accordance to these terms and conditions is formed upon an official order from the customer and is accepted by the company this can be a verbal, written and or a signed for quotation

3, Customers Obligations

  • A, The customer must maintain the props in there original condition from the day of hire
  • B, Any damages must be paid for by the customer
  • C, Where the prop is beyond repair the full RV must be paid by the customer
  • D, The customer must be insured to the full value of the total RV of all the props hired

4 ,Hire Costs

  • A, 1 week is the minimum hire (7 days) will be charged at 10%
  • B, 2 weeks (14 days ) will be charged at 18%
  • C, 3 weeks (21 days) will be charged at 23%
  • D, Additional weeks will be charged at 3% per week or part of
  • E Longer hire terms can be negotiated between the customer and the company

 

5, Payment Terms

  • A, Payment to be made upon hire commencement for the relative period of hire
  • B, Any additional hire must be paid when agreed with the company
  • C, At the discretion of the company a 14-day payment term may be applied from the invoice date
  • D, All quoted figures are subjected to vat at the current rate

6. Limitation of Liability and Warranty of Goods

  • A, The Company shall not be liable to the Customer for any loss of profit, damage, injury or any indirect or consequential loss arising under or in connection with services provided or as a result of the hired goods to be found not being fit for the purpose intended by the Customer.
  • B, The Company shall not be liable to the Customer as a result of any delay or failure to perform its obligations under this contract as a result of an event beyond the reasonable control of the Company.
  • C, No warranty will be provided for goods from the company whether expressed or implied and all responsibility will rest with the customer and therefore the companies liability with respect to the goods supplied and there use by the customer is hereby excluded

7, General and Intellectual Property Rights Provisions/Clearance of Items

  • A, The customer must preform its own due diligence in connection with intellectual property rights clearance provision the company will take no responsibility for any breach in this area,  if you have any doubts or concerns please seek legal advice

8. Customers Future use of the Props

  • A, The company cannot guarantee the customer any future use of the props once returned by the customer to the company as these may not be available for any number of reasons

9, Governing Law

  • A, The Conditions shall be governed by and construed in accordance with the laws of England and Wales and both parties agree to submit to the exclusive jurisdiction of the English and Welsh Courts.
